The James Hardie Group comprises various individual companies. Wherever one of our group companies is involved, the "controller" of your personal data is the company that determines the purposes and means of processing your personal data, either alone or jointly with another James Hardie Group company or another group company. A list of the companies within the James Hardie Group to which this privacy policy applies can be found in section 18.

Where this privacy policy refers to "we", "us", "our" or "James Hardie", this refers to the company (or companies) within the James Hardie Group that processes your personal data as a controller under the GDPR.

James Hardie processes personal data from various categories of personal data in the course of its normal business activities. This personal data may relate to individuals working for potential and existing suppliers and customers, including employees working for parties such as dealers, distributors, architects and builders. Personal data may also relate to individuals who visit our websites, download our online applications, contact us via social media or at business events, or call our telephone lines.

As a general rule, James Hardie™ only collects and processes personal data where this is permitted by law. This includes where it is necessary to fulfil a contract or provide a service offered by us, where we have a legitimate interest in processing the data, or where consent has been given.

2. From whom and in what way are we permitted to collect personal data?

We may collect and process data relating to the following categories of data subjects:

  • Past, current and prospective customers, including dealers, distributors, retailers, sales partners, contractors, architects and end users (collectively, "customers").

  • Past, present and future individuals who provide goods and services to us, including, without limitation, temporary staff, contractors, outsourced service providers, consultants, experts, board members, auditors, dealers, distributors, suppliers and vendors (collectively, “Suppliers”) to us;

  • Participants in sponsored prize draws or competitions;

  • Complainants, correspondents and enquirers;

  • Current, former and prospective shareholders;

  • plaintiff or defendant in current or future legal proceedings;

  • marketing contacts, journalists, trade associations and lobbyists; and

  • People who visit our websites, download our online applications, connect with us via social media or at business events, or call our telephone lines.

We collect this personal data because you have provided it to us:

  • by entering information on one of our websites;

  • by visiting your company;

  • by using our mobile applications;

  • via social media platforms;

  • when you contact us by telephone, email or other means;

  • by taking part in competitions organised by us;

  • through surveys carried out by us or on our behalf;

  • when you sign up to receive newsletters, special offers and other promotions;

  • when taking part in promotional events, seminars or training courses and

  • when you create an account with us.

Or we collect this personal data about you directly from you:

  • because you have consented to your data being shared as part of your company website, your public profile, your social media account or any other website that you operate or use;

  • because you have consented to your data being shared on online registers, professional platforms and websites for the purpose of establishing contact with third parties, including suppliers and customers;

  • because your information would otherwise be publicly available, for example to journalists, trade associations or lobbyists

  • because you have visited our websites, where we may track, for example, browsing history, location data, website logins and other communication data, as well as the content you have viewed;

  • technical information, including anonymous data collected by the hosting server for statistical purposes, the IP address used to connect your computer or device to the internet, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;

3. What data do we collect?

The data we may collect and process includes, for example

  • Name

  • Contract details (address, telephone number, fax number, email address);

  • The company you work for;

  • Job title(s) and/or role(s);

  • Department and/or business unit;

  • Your signature;

  • Customer records (purchase history, customer service, warranty history, purchasing preferences, etc.);

  • Technical data (IP addresses and data stored in cookies – see section 12 below for further information on cookies);

  • GEO-caching data, e.g. when you log in using a mobile device and have enabled the feature on your mobile device that allows us to locate you via GPS;

  • Credit rating and bank details;

  • Credit limit and payment terms;

  • Identification details contained in official identity documents, where permitted under national law;

  • Sales information relating to the sale of products or services;

  • Images (e.g. photographs)

  • Correspondence or other communications with you regarding our products, services or business dealings.

4. For what purposes do we use personal data?

We use the information we hold about you for the following purposes:

  • Customer service purposes, including the provision of products and services to customers, the receipt, verifying, processing and delivering orders and returns, invoicing and processing payments, managing credit limits, warranties, technical support or similar purposes, as well as setting up and maintaining customer accounts;

  • Communicating with customers, including responding to requests for assistance and updating them on the status of their orders by post, email, telephone and/or text message;

  • Information relating to administration, including access to and use of our websites (known as website analytics; see section 13 below for further details) and social media platforms (see section 15 below for further details);

  • Interest-based online marketing (targeting; for further information, see Chapter 12);

  • Marketing and promotional purposes, including via email or equivalent electronic media, to send messages and newsletters, special offers and promotions, or to inform customers in other ways about products, services or information;

  • to review and process orders and suppliers’ purchase or sales history; to exchange information, including performance indicators, regarding goods or services; and to organise seminars, events, training sessions and marketing activities;

  • to facilitate the administration of the corporate structure, management and management reporting, and organisational contacts;

  • where necessary, to update, rectify, block or erase personal data; to allow data subjects to access and verify their personal data;

  • Research purposes, including market and industry research, for day-to-day correspondence (e.g. emails, letters, etc.), compliance with applicable legal obligations, including responding to a court order, and to facilitate risk management, compliance, legal and audit functions.

  • for marketing purposes, including by email or other equivalent electronic means, to send you messages and newsletters, special offers and promotions, or to contact you in other ways regarding products, services or information;

When companies within the James Hardie Group combine products, services, systems, databases and businesses in order to ensure business continuity and to operate a centralised and efficient administration. This may be the case, for example, if data held in a marketing or CRM system of a James Hardie Group company, such as Fermacell GmbH, is combined with and/or migrated to a marketing or CRM system of another company within the James Hardie Group, such as James Hardie Europe B.V.

  • to provide our customers and website users with digital tools or features;

  • for profiling and statistical analysis. For example, we may combine different categories of personal data that we collect about you online or when you purchase our goods;

  • When you visit our website, we may use certain cookies;

  • when you visit our social media platforms so that we can get in touch with you;

  • to use your photograph, video or ID in certain circumstances;

  • for the purpose of asserting or defending legal claims.

6. Who has access to your personal data?

Where permitted under applicable data protection laws, the personal data you provide may be disclosed to the following recipients or categories of recipients:

  • Authorised persons who work for us or on our behalf (e.g. those working in operations, IT, human resources, finance, marketing and customer service);

  • Agents, service providers and consultants whom we engage (e.g. companies within the James Hardie Group and third-party providers and consultants who provide services relating to marketing, customer service, transport, storage, security and analysis of personal data, application development, payment and credit cards, procurement and compliance checks);

  • Our partners, in order to offer you joint products and services in conjunction with our own products and services, or where these partners sponsor or participate in our events and conferences.

  • Other authorised third parties in connection with a potential sale, disposal or transfer of one or more companies within the James Hardie Group (including any shares in the company) or a combination of their products, services, assets, affiliates and/or businesses.

  • With third parties to enforce our terms and conditions, agreements, policies or rules; to protect the security, integrity and availability of our products, systems and services, to exercise or protect the rights and property of the James Hardie Group (including intellectual property), to comply with legal requirements, or in other cases where we believe in good faith that disclosure is required by law (including in response to a lawful subpoena or other request from law enforcement authorities).

  • Law enforcement or government authorities, where this is necessary to comply with applicable law.

Where permitted under applicable data protection laws, your personal data may be shared with and processed by other members of the James Hardie Group, including, but not limited to, the companies listed in section 18. This may be the case, for example:

  • When companies within the James Hardie Group work together to provide services to other companies within the Group in the areas of operations, IT, human resources, finance, marketing and customer service;

  • To safeguard the security, integrity and availability of our products, systems and services;

  • When different companies within the James Hardie Group collaborate to develop products and services; and

  • When companies within the James Hardie Group combine products, services, systems, databases and businesses. This may be the case, for example, when data held in a marketing or CRM system of one James Hardie Group company is combined with and/or migrated to a marketing or CRM system of another James Hardie Group company.

Where other members of the James Hardie Group or such third parties act as "data processors", they carry out their tasks on behalf of the data controller and in accordance with the data controller’s instructions for the purposes set out above.

7. International money transfers

When data is transferred to other members of the James Hardie Group or to third parties, your personal data may be collected and processed in a country outside Europe. If these jurisdictions do not provide adequate protection (as determined by the European Commission, Art. 45 GDPR), we ensure prior to the transfer that the transfer is safeguarded either by the recipient’s self-certification under the EU-US Privacy Shield (for US recipients only) or by entering into so-called European Union Standard Data Protection Clauses with the recipient.
 

You are entitled to a list of recipients in third countries and a copy of the specific provisions agreed to ensure an adequate level of data protection. Please contact us using the contact details in section 16.

8. Security of your data

To ensure the protection of personal data, we maintain physical, technical and administrative security measures. We continuously update and test our security technology. We generally seek to restrict access to your personal data to those individuals working for James Hardie Group companies who require this information and who always act in accordance with applicable law.

In addition, we train our staff on the importance of confidentiality and the protection of your privacy and the security of your personal data. We are committed to taking appropriate disciplinary action to ensure that our staff fulfil their data protection responsibilities.

Please note, however, that despite our best efforts, no security measures are perfect or impenetrable. We cannot and do not guarantee that the information you provide to us will remain secure, nor do we guarantee that such information will not be accessed, disclosed, altered, destroyed or used in any unauthorised manner.

If we become aware of a security breach, we may attempt to notify you electronically so that you can take appropriate protective measures. We may also post a notice on our website if a security breach occurs. Depending on where you live, you may have the right to receive written notification of a security breach.

9. Data storage and retention

Your personal data may be stored in various systems, including our CRM and ERP systems, email clients, James Hardie’s servers and on the servers of the (cloud-based) services operated by James Hardie in the United States, Australia and in countries within the European Union. Where possible, we will endeavour to encrypt your personal data during storage and transmission.
 

James Hardie endeavours to retain your personal data only for as long as is necessary to fulfil the purposes for which the personal data was collected, unless permitted or required by applicable laws or regulatory requirements (in particular retention periods). We will also retain and use your data for as long as is necessary to resolve disputes and/or to enforce our rights and agreements. We store account information relating to existing, former and potential customers and sellers for as long as the account is active and thereafter for a period subject to statutory retention periods. Non-personally identifiable and aggregated information may be stored indefinitely. Further details can be found in our Privacy Policy, which is available on request.

10. Right of access, rectification and erasure of your personal data, and other rights of the data subject

The European Union’s General Data Protection Regulation and the data protection laws of other countries provide for certain rights for data subjects.
 

Right of access and rectification: You have the right to request access to any personal data that James Hardie may hold about you, and to request the correction of any inaccurate data relating to you.
 

Right to erasure: Provided that the legal requirements are met, you may request the erasure of your data. This does not apply to personal data that is subject to a statutory retention period or that is necessary for the establishment, exercise or defence of legal claims.
 

The right to lodge a complaint: You have the right to lodge a complaint with the relevant data protection authority, in particular in the country where you live, work or where the alleged infringement occurred, if you believe that the processing of your personal data breaches applicable law.
 

Right to restriction of processing: You have the right to restrict the processing of your personal data in certain circumstances.
 

Data portability: If Where we rely on your consent or on the fact that processing is necessary for the performance of a contract to which you are a party as the legal basis, and where personal data is processed automatically, you have the right to receive all personal data that you have provided to James Hardie™ in a structured, commonly used and machine-readable format and to request that we transmit it to another controller, where technically feasible.
 

Right to object: Where we rely on a legitimate interest as the basis for processing your data, you have the right to object to such processing on grounds relating to your particular situation, and we must cease such processing unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or where we need to process the data for the establishment, exercise or defence of legal claims. We generally believe that, in cases where we rely on a legitimate interest as the basis for processing, we can demonstrate such compelling legitimate grounds, but we will assess each case individually. You also have the right to object to the processing of your personal data for marketing purposes at any time. Please also refer to the section "Information about your rights to object".

Right to withdraw consent: If Where we rely on your consent to process your data, you have the right to withdraw that consent at any time, without this affecting the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal. This applies in particular to cookies, and we have implemented features on our website to facilitate this.

11. Are you required to provide your personal details?

You can interact with us without providing any personal data. Please note, however, that in this case certain features or services may not be available to you.

We use the Facebook Lead Ads service provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Meta”), to display advertisements to you and other interested users on Facebook and other websites, and to give you the opportunity to provide us with your contact details, such as …, as well as information about … In doing so, you can share the data you have already stored on Facebook with us. We use your name to address you personally, your email address to contact you personally, and the details regarding … to personalise newsletter content for you. . To this end, Meta may use cookies, web beacons and other storage technologies and collect your IP address as well as other information. Meta does not clearly and conclusively specify how it uses the data for its own purposes, to what extent activities on the Facebook page are attributed to individual users, how long Meta stores this data, or whether data is passed on to third parties, and we are not aware of this.

Data processing is carried out with your consent on the basis of Article 6(1)(a) of the GDPR. You may withdraw your consent at any time with future effect via our consent management platform, which you can access here, without this affecting the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal.
